1. Introduction

These Terms of Service ("Terms") govern your access to and use of the Refy9 platform, including:

• mobile and web applications,
• website and related services,
• wardrobe and style features,
• community and messaging tools,
• recommendation and decision-support features,
• optional third-party integrations.

By accessing or using Refy9, you agree to be bound by these Terms and all policies referenced herein.

If you do not agree, you must not use the platform.

2. About Refy9

Refy9 is a personal style and lifestyle companion platform that helps users:

• organize wardrobes,
• explore outfit ideas,
• engage with a community,
• discover products from external retailers.

Refy9 is not:

• a seller,
• a retailer,
• a marketplace,
• a payment processor,
• a fulfilment or logistics provider.

Any purchases occur outside the Refy9 platform and are governed solely by third-party retailers.

3. Eligibility

You may use Refy9 only if:

• you are at least 13 years old, and
• you have the legal capacity to enter these Terms.

Users between 13 and 18 years must use Refy9 with parental or guardian guidance. We may restrict, suspend, or terminate accounts if eligibility requirements are not met.

4. Account Registration and Security

When creating an account, you agree to:

• provide accurate and up-to-date information,
• maintain the confidentiality of your credentials,
• take responsibility for all activity under your account,
• notify us immediately of unauthorized access.

Refy9 is not responsible for losses caused by compromised accounts resulting from your actions or negligence.

5. Nature of the Service

Refy9 provides digital tools that may include automated, algorithmic, or system-assisted features intended to support user decision-making.

Outputs, suggestions, or insights generated by the platform:

• may be subjective,
• may be incomplete or inaccurate,
• are informational only.

You remain solely responsible for your decisions and actions.

6. Permitted Use

You may use Refy9 for personal, non-commercial purposes in accordance with these Terms.

You may not:

• resell or sublicense access,
• scrape, extract, or harvest data,
• use bots, crawlers, or automation,
• reverse engineer or copy the platform,
• interfere with platform security or operations,
• use the platform for unlawful purposes.

7. Prohibited Conduct

You must not engage in conduct that is harmful, abusive, deceptive, or unlawful, including but not limited to:

• harassment, threats, or hate speech,
• impersonation or fraud,
• solicitation or scams,
• posting explicit or illegal content,
• violating privacy or intellectual property rights,
• uploading malware or harmful code.

Violations may result in immediate enforcement action.

8. User Content

You may upload or share content such as:

• images,
• posts or comments,
• profile information,
• messages to approved contacts.

You represent and warrant that:

• you own the content or have lawful rights to share it,
• identifiable individuals have given consent,
• the content complies with applicable laws and policies.

You remain solely responsible for your content.

9. License Granted to Refy9

You retain ownership of your content.

You grant Refy9 a limited, non-exclusive, revocable license to:

• store, host, and display your content,
• process it to provide requested services,
• apply visibility settings you choose,
• maintain backups until deletion.

We do not use your content for external advertising without explicit permission.

10. Community Features and Messaging

Community participation and messaging are governed by the Community Standards.

Messaging is permitted only between mutually approved contacts. Refy9 may restrict or disable messaging or community features at any time for safety or compliance reasons.

11. Third-Party Products and External Purchases

Refy9 may display product information or links from third-party retailers.

Refy9:

• does not verify product accuracy,
• does not process orders or payments,
• does not manage delivery, returns, or refunds,
• is not responsible for disputes or losses.

All transactions occur directly with the retailer.

12. Third-Party Integrations

Some features depend on external services or APIs. These may change, fail, or become unavailable.

Refy9 is not liable for disruptions caused by third-party services.

13. No Duty to Retain Data

Refy9 has no obligation to:

• retain user content,
• restore deleted data,
• maintain backups for user access.

Users are responsible for backing up their own data.

14. Suspension and Termination

Refy9 may suspend or terminate accounts, with or without notice, if:

• these Terms or policies are violated,
• safety or legal risks arise,
• fraudulent or abusive behaviour is detected,
• required by law.

Termination does not limit other legal remedies.

15. Intermediary Status (India)

Refy9 acts as an intermediary under applicable Indian law.

This means:

• users are responsible for their content,
• Refy9 does not endorse user content,
• Refy9 is not liable for user-generated content, subject to legal obligations.

16. Disclaimer of Warranties

Refy9 is provided "as is" and "as available."

We do not guarantee:

• uninterrupted access,
• error-free operation,
• accuracy of outputs or content,
• availability of features,
• suitability for specific purposes.
• Compatibility with all devices.
• Real-time availability.

You use the platform at your own risk.

17. Limitation of Liability

To the maximum extent permitted by law:

Refy9 is not liable for indirect, incidental, consequential, or punitive damages.

Refy9 is not liable for losses arising from:

• user content or interactions,
• external purchases,
• automated outputs or suggestions,
• service interruptions,
• data loss,
• third-party services.

Any direct damages must be proven, nominal, and solely caused by Refy9's negligence.

18. Indemnification

You agree to indemnify and hold Refy9 harmless from claims arising out of:

• your content,
• your conduct,
• your violations of these Terms,
• your disputes with third parties.

19. Intellectual Property and Feedback

All platform intellectual property belongs to Refy9.

Any feedback or suggestions you submit may be used by Refy9 without compensation.

20. Governing Law and Jurisdiction

These Terms are governed by the laws of India.

Courts in Ahmedabad, Gujarat have exclusive jurisdiction, subject to arbitration provisions below.

21. Arbitration and Class Action Waiver

Disputes shall be resolved by binding arbitration under the Arbitration and Conciliation Act, 1996.

You waive the right to:

• participate in class actions,
• bring collective or representative claims.

Only individual claims are permitted.

22. Changes to These Terms

We may update these Terms periodically. Continued use of Refy9 constitutes acceptance of updated Terms.

23. Severability

If any provision is held invalid, the remaining provisions remain enforceable.

24. Entire Agreement

These Terms, together with the:

• Privacy & Data Protection Policy,
• Community Standards,
• Cookie Policy,

constitute the entire agreement between you and Refy9.
